Access to and use of the website www.ladress.com and the products and services available through this website are subject to the following terms and conditions. We may update and adapt the terms and conditions from time to time. Your continued use of this website following such change shall signify your agreement to be bound by the modified terms. Please check this page regularly to take notice of any changes. If you disagree with any change, then you must immediately stop using the website.

You can make use of our Loyalty Program by registering as Member on our website. After teh first purcahse on your client account, you automatically become a Member! We process updates in the Member status of our customers regularly. Your Membership status is based on net purchases made on your client account.

Being a Member gives you access to certain Membership privileges, such as invitations to Member events and the possibility to book a shopping experience in our Showroom. Please note that you will only receive invites and special offers when you remain signed up for our newsletter.

As a Member you are entitled to a Membership discount on all purchases, except for discounted items, such as Sale styles or purchases for which you want to use a promotion code. Your Membership discount also does not apply on the purchase of gift vouchers. The discount will be applied at the check-out, provided you are signed in. The discount percentage that applies to you, depends on your Loyalty status.

Your Membership status is based on net purchases made on your client account. Taking into account our 30 day return policy on purchases made, the Membership changes are processed 30 days after purchase.

The Memberships are as follows:

Premium valid as of the first purchase – 5% Member discount

Bronze as of EUR 250 - 10% Member discount

Gold as of EUR 750 – 15% Member discount

Diamond as of EUR 4000 - 20% Member discount

To use some of the features on this website you may need to register. Registration requirements may change from time to time. In order to make purchases through the site, you will be required to register and provide us with your personal details. In particular, customers must provide their real name, phone number, e-mail address and other requested information as indicated. Furthermore, when ordering items, you will be required to provide payment details and you represent and warrant that the payment details you provide on ordering are both valid and correct. You confirm that you are the person referred to in the billing information provided.

The site is available only to individuals and others who meet the LaDress terms and conditions. Customers who have been issued a valid credit card by a bank or a bank account acceptable to LaDress can only place orders. Applications must be acceptable to LaDress and LaDress is authorized to process the total amount of an order on customer's credit card or bank account. LaDress reserves the right to restrict multiple quantities of an item being shipped to any customer or postal address.

By making an offer to purchase merchandise, you expressly authorize us to perform credit checks and, where LaDress feels necessary, to transmit or to obtain information (including any updated information) about you to or from third parties from time to time, including but not limited to your credit card number or credit reports, to authenticate your identity, to validate your credit card, to obtain an initial credit card authorization and to authorize individual purchase transactions.

Furthermore, you agree that we may use personal information provided by you in order to conduct appropriate anti-fraud checks. Personal information that you provide may be disclosed to a credit reference or fraud prevention agency, which may keep a record of that information. Please refer to our privacy policy for further information about how we use your data.

LaDress offers items for sale that are in stock and available for dispatch from our distribution center. Occasionally, however, we may be waiting for shipments from our suppliers. Consequently you may from time to time be given the possibility of making an advance payment for certain items in which case you are able to make an advance purchase. This will ensure that you receive this item in priority once stock has been delivered to LaDress. LaDress will only take advance purchase orders for stock that has been scheduled for delivery by a supplier. Your rights regarding advance purchase are the same as those for any other purchase at LaDress.

Items received into stock may be pre-allocated to satisfy advance payment orders and customers making advance payments will receive items in priority to customers on the pre-order list. Please be aware that we may be unable to deliver selected advance payment merchandise due to production problems or quality check issues identified when we receive an order into stock. In these circumstances we will notify you by e-mail and refund the advance payment to your credit card or bank account within ten days of being notified that merchandise has become unavailable.

Please note that items in your shopping bag are not reserved and may be purchased by other customers.

All orders are subject to acceptance and availability. 21% VAT is included in all prices at the current rates and are correct at the time of entering information. We reserve the right to change prices without prior notice to you, until both parties have agreed upon the contents of the agreement. We will take all care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part, we cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from the website.

Customers purchasing from a country outside the European Union need to pay import duty or tax costs. We recommend you contact your local customs authority to determine a landed cost price prior to purchase completion.

Once you have made your choice and your order has been placed, you will receive an e-mail acknowledging the details of your order. This e-mail is not an acceptance of your order, just a confirmation that we have received it.

Unless you cancel your order, acceptance of your order and completion of the agreement between you and LaDress will be completed when we e-mail you to confirm the goods have been dispatched.

We reserve the right not to accept your order in the event, for example, that we are unable to obtain authorization for payment, that shipping restrictions apply to a particular item, that the item ordered is out of stock or does not satisfy our quality control standards and is withdrawn, or that you do not meet the eligibility criteria as set out in these terms and conditions.

We may also refuse to process and therefore accept a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any merchandise from www.ladress.com whether or not that merchandise has been sold; removing, screening or editing any materials or content on www.ladress.com; refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

Payments can be made by Visa, MasterCard, American Express, iDeal (only for The Netherlands), Maestro, Sofort, Giropay, Paypal, Bancontact and Bank transfer.

You confirm that the credit/debit card that is being used is yours or that you have been specifically authorized by the owner of the credit/debit card to use it. All credit/debit cardholders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to LaDress, we will not be liable for any delay or non-delivery.

We take all reasonable care to make www.ladress.com secure. All card transactions on www.ladress.com are processed using Ogone, a secure online payment gateway that encrypts your card details in a secure host environment.

To help ensure that your shopping experience is safe, simple and secure LaDress uses Secure Socket Layer (SSL) technology.

Besides SSL encryption, PaySquare makes use of 3-D Secure. 3-D Secure represents an extra level of security for you when placing an order. It protects you against misuse of your creditcard number, because you confirm your identity first, before you make the payment. Only if you are the legal owner can your creditcard be used to make an Internet payment.

Please be careful with all the packaging and additional gifts your order has been sent with. Keep it away from children and animals, to avoid suffocation danger. Also keep it away from fire, the packaging could be inflammable. LaDress cannot be held responsible for any damage or accidents caused by the packaging and/or additional gifts.

We insure each purchase during the time it is in transit until it is delivered to you. We require a signature for any goods delivered, at which point responsibility for your purchased goods passes to you. If you have specified a recipient other than yourself for delivery purposes (for example as a gift) then you accept that evidence of a signature by them (or at that delivery address) is evidence of delivery and fulfillment by LaDress and transfer of responsibility in the same way.

Please note that we aim to dispatch all orders within 48 hours. Estimated delivery times are to be used as a guide only and commence from the date of dispatch, LaDress is not responsible for any delays caused by destination customs clearance processes.

You can check the current status of your shipment by going to www.ups.com. Type in your unique air waybill number, which we e-mailed to you, and UPS, will track your shipment for you.

Customer satisfaction is our top priority. If you are not happy with your goods or need to exchange an item for a different size, you may return your order within 30 days following the date that you receive the goods. In order to receive a refund to your credit card, you must abide by the instructions below. If you would like to have any assistance, please send an e-mail to info@ladress.com.

The product you return must be in new, unused, and unworn condition with all the original packaging and garment tags still attached. All accurately returned products will be credited to the original purchasers credit card excluding taxes, duties and shipping costs. We also offer store credits. The amount you have paid can be stored with us up until your next purchase. You are able to use the amount stored at any time you prefer.

New and unused means that there are no marks on the item or anywhere on the tags. We do not sell used items and will not accept any item with any indication that it was used. In such cases, the item will be returned to the purchaser.

LaDress is not responsible for any item that is not returned in the manner set forth above. Please discuss any additional questions you may have with a customer service representative when you contact us for our exchange and return procedure. You can reach us on workdays from 9 am until 6 pm.

You may prefer to return or exchange items using our free returns and exchanges collection service. This free collection service is available for countries in the European Union, except for The Netherlands. You must request a return pick up for your unwanted items within 14 days for a refund of the value of the item only, or an exchange for the same item in a different size (based on stock availability).

If you have received an item from LaDress as a gift you can exchange it for another item of the same value. For international orders you must pay taxes and import duties.

Content is defined as any text, photographs, video, audio or graphics that LaDress, you or any other user may upload or transmit on this website. You bear the entire risk of the completeness, accuracy or usefulness of any content on this website. LaDress reserves the right to withdraw any content from this website at any time and for any reason. Removal may be immediate and without notice. You agree that LaDress is not liable to you or any third party for any such withdrawal.

You may not use LaDress, or any of its content, for any commercial end. Nor for any advertising activity on your own website. This website is for your personal use only. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, commercially exploit, create derivative works from, transfer, or sell any content, software, products, or services contained within this website.

We reserve the right to deny you access to this website at any time, without notice. You acknowledge that LaDress is the owner of all rights to all the content, software and all HTML and other codes contained in this website, shall remain with LaDress and its licensors and is protected by copyright and other laws and internatinoal treaty provisions. LaDress shall only be liable for losses, which are, direct losses and a reasonably foreseeable consequence of such a breach. Losses are foreseeable where, for example, you and LaDress at the time of you placing your order, and LaDress dispatching your order could contemplate them. We shall only be liable for losses up to 150% of the total value of goods purchased.

We are not responsible for indirect losses which are a side effect of the main loss or damage and which are not reasonably foreseeable by you and us (for example, loss of profits or loss of opportunity).

We are also not responsible for failure to meet any of our obligations under the terms and conditions where such failure is due to force majeure.

You agree to indemnify, defend and hold harmless LaDress from damages and/or costs, arising from your use of this website or your breach of these terms and conditions.

You acknowledge that no joint venture, partnership, employment, or agency relationship exists between you and LaDress as a result of your use of this website. You agree that you will not hold yourself out as a representative of LaDress, and we shall not be liable for any representation, act, or omission on your part.

These terms and conditions constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and LaDress.

You confirm that, in agreeing to accept our policies, you have not relied on any representation save in so far as the same has expressly been made a representation in LaDress, and you agree that you shall have no remedy in respect of any misrepresentation that has not become a term of LaDress save that your agreement contained in this clause shall not apply in respect of any fraudulent misrepresentation whether or not such has become a term of LaDress.

If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.

LaDress will be governed by and construed in accordance with the laws of The Netherlands, and you irrevocably submit to the exclusive jurisdiction of the courts of The Netherlands.
